Elements: To be arrested for public intoxication in the State of California you must:

1)      Be unable to exercise care for your safety or the safety of others (You must be VERY intoxicated to meet this requirements such as unable to walk)

2)      Interfere with, obstruct, or prevent others from using streets, sidewalks, or other

Being very drunk in public is NOT enough of a reason for police to arrest you!

Penalties: Public intoxication is a misdemeanor and carries a maximum sentence of 6 months in county jail and/or fines up to one thousand dollars

Defenses: An able attorney could try to prove one or all of the following in order to dismiss the charge:

–          You were not intoxicated

–          You were not in a public place

–          Your rights were violated during the process
