What is an ignition interlock device?

Drunk driving is taken seriously in California, so people who are convicted of this crime can face a host of sentencing options. One of these is the requirement to install an ignition interlock device on any vehicle the individual drives. 

An ignition interlock device requires a breath sample from the driver in order for the engine to start. It also triggers periodic checks while the vehicle is in motion. When that occurs, the driver has a preset amount of time to pull over and provide the sample. 

An ignition interlock device contains a small breath testing device that records the results of each test. It also tracks attempts to circumvent the device. Some devices contain cameras to track who’s blowing into the device. Those results are sent to the agency that’s tasked with monitoring the driver. 

When are ignition interlock devices required in California?

Under California law, ignition interlock requirements can vary depending on the circumstances of the DUI offense:

  • First-time DUI: A judge may order an ignition interlock device, especially if the offense involved injury. In many cases, first-time offenders can choose to install one for a shorter license suspension period.
  • Repeat offenders: For second and subsequent DUI convictions, these devices are typically mandatory for a specified length of time, often ranging from one to three years.
  • DUI with injury: If the offense caused injury to another person, an ignition interlock device is usually required, even for a first-time conviction.
